Can I make a claim against my business interruption insurance due to Coronavirus?

por | Abr 6, 2020 | Insurance

Business interruption insurance covers a certain amount of your expenses while your business is closed or unable to operate due to a covered loss.  Nearly every policy specifically excludes an infectious disease as a covered loss.  For example, the Coronavirus.  Thus, making it very difficult to claim that as the cause of your loss.  But what if there was a different approach.

The reason your business closed during the Coronavirus closed was likely not because you had a contamination at your business. But rather, because the local officials in Florida required your business to close under a “stay at home” order.  This would be civil authority.  The key is in your policy.  If your policy provides coverage under civil authority, then you might be able to make a claim. Otherwise, a skilled Attorney will want to review the policy and circumstances to determine if there is a covered loss.

If your loss is covered, the next question to ask yourself is what expenses are typically covered under business interruption insurance, if you were to make a claim:

  1. Employee wages
  2. Rent or lease payments
  3. Relocation costs
  4. Loan payments
  5. Operating expenses
  6. Lost revenue
